Selling a home in Alaska: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Alaska seller disclosure / supported exception. Before the buyer makes a written offer, AS 34.70 requires the seller to deliver the completed current Alaska residential transfer disclosure unless a specific exemption or genuinely executed lawful waiver applies. Upload the disclosure or supported exemption evidence. A seller cannot waive disclosure for a buyer. Later material amendments retain applicable statutory termination rights; receipt here does not waive them.
  • Alaska applicable property-specific notices. Investigate access, title and mineral interests, seismic and flood risks, water, sewage, heating and environmental conditions. Disclosure is not a warranty or substitute for inspections. This ordinary resale agreement excludes developer/new-construction, cooperative, leasehold and installment land transactions.
  • Alaska association resale records / supported exception. For a covered common-interest resale, AS 34.08.590 requires governing documents and an association resale certificate. The association responds within ten days of written request and the applicable fee. The buyer may void until delivery and for five days thereafter or conveyance, whichever first occurs. Actual statutory scope and transfer exceptions, including any qualifying affidavit route, require documented support. NavStreet collects the applicable packet or supported exception before offers as an early-collection policy; it preserves statutory rights.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
