Selling a home in Arkansas: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Arkansas seller condition disclosure. Arkansas does not impose a universal seller property-condition disclosure form on an ordinary FSBO resale. Seller must not conceal or misrepresent material conditions and shall answer inquiries truthfully. Any voluntarily supplied statement is separate from this agreement and is not an independent inspection or warranty. Broker/licensee disclosure and agency duties apply when such professionals participate; this platform agreement does not substitute for them. Optional condition records cannot prevent the parties from making an offer.
  • Arkansas property-specific supporting records. Buyer may investigate structure, title, access, flood and insurance risk, utilities, private well/septic systems, permits and known hazards during the negotiated inspection period. Seller shall provide available requested records. This agreement imposes no universal new inspection, tax-estimate, radon certificate or septic upload. Required federal lead disclosures apply separately to covered pre-1978 housing.
  • Arkansas association resale records. Under the Arkansas Horizontal Property Act, Ark. Code 18-13, the unit and its appurtenant common interests convey under the recorded master deed and bylaws. Review restrictions, insurance, budgets, reserves, assessments, litigation and parking/storage allocations during the agreed inspection period. Seller shall cooperate in obtaining an association account statement and clear assessments chargeable to seller. Section 18-13-116 addresses unpaid assessments at sale; the contract does not authorize avoiding those charges by transfer. This ordinary nondeveloper resale creates no universal statutory initial-offer condo packet or cooling-off period. Developer construction/deposit arrangements are excluded.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
