Selling a home in Delaware: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Delaware seller condition disclosure or supported exception. For covered transfers, 6 Del. C. 2572 requires written disclosure of known material defects when offered for sale and updates for material changes through final settlement. Under section 2573, seller, agent or subagent shall give the current Commission Seller’s Disclosure of Real Property Condition Report to prospective buyer or buyer’s agent before buyer makes an offer. The report signed by buyer and seller becomes part of this purchase agreement. Seller shall provide the current report and obtain both parties’ required signatures separately; a receipt dropdown or signature on this agreement does not sign that separate form. Claimed section 2577 exceptions require signed supporting certification. Heirs selling inherited property are not automatically exempt. The report is not a warranty or substitute for inspection.
  • Delaware applicable property-specific records. For covered transfers, section 2572A requires notice of radon exposure potential, possessed testing/inspection information, known radon hazards, health-department information, and the Commission radon form with buyer and seller acknowledgments, dates and signatures. Buyer has an option to test; selecting received is not execution of the separate form and the statute does not require a new test in every sale. The statutory packet shall include the current radon form, informational notices and possessed reports, or signed evidence of an applicable exception. Review the condition form’s allocation of street repair/repaving costs. Applicable septic, well, coastal, flood and insurance records shall be investigated during the agreed inspection period.
  • Delaware association records. For a Montana condominium resale, upload a complete packet containing the Unit Ownership Act, association bylaws and administrative regulations. Include the seller or other person’s majority-control notice under MCA 70-23-613(1) whenever any person or entity constitutes a majority of the unit owners. Deliver requested documents before any buy-sell signing. The agreement preserves the 72-hour review and penalty-free withdrawal period. These condominium documents are not a universal upload requirement for non-condominium properties. Dues, assessments and other helpful records may accompany the packet; unknown information is not assigned to the buyer.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
