Selling a home in Illinois: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Illinois seller condition disclosure. 765 ILCS 77 requires the seller Residential Real Property Disclosure Report before the signing of a contract, unless a specific seller/transfer exclusion applies. It covers condominium units and their allocated limited common elements as specified by the Act. Seller must complete the statutory report and supplement a known error or omission before closing. The buyer acknowledges only actual receipt of the identified version; a receipt does not warrant condition or waive remedies. The Act preserves specified five-business-day termination rights for qualifying late material-defect reports/supplements and other statutory remedies. Federal lead and the independent Illinois radon duty are not waived by a condition-report exception.
  • Illinois radon disclosure packet. Unless excluded by 420 ILCS 46/20, seller shall give the Illinois Disclosure of Information on Radon Hazards, known hazard records and the approved IEMA-OHS Radon Testing Guidelines for Real Estate Transactions pamphlet before buyer is obligated. Section 10(c) permits disclosure after an offer, but requires completion before seller acceptance and an opportunity for buyer review and possible amendment. NavStreet collects this required pre-acceptance disclosure earlier: seller uploads the applicable packet before Make Offer opens, and buyer reviews it and the supplied pamphlet before submitting. No radon test or mitigation is universally required merely to make an offer.
  • Illinois association resale records. For condominium resale by a nondeveloper, 765 ILCS 605/22.1 requires seller to obtain and make available upon demand the declaration/bylaws/rules, assessment/lien statement, anticipated capital expenses, reserves, financials, litigation, insurance, alteration-compliance information and designated notice contact. Common-interest community resales have separate duties under 765 ILCS 160/1-35. Request records promptly; these are not universal initial-offer upload or statutory cooling-off gates. The agreed inspection/document condition protects buyer review without inventing a mandatory waiting period. From January 1, 2027, comply also with the collection-policy addition of P.A. 104-0734. Developer/new-construction and leasehold sales are excluded.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
