Selling a home in Kentucky: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Kentucky seller condition disclosure / supported exception. KRS 324.360 applies where a licensee receives compensation; it is not a universal private-owner FSBO condition-form requirement. Disclose known latent material defects truthfully and provide available records. A voluntary seller statement is not a warranty. This owner-direct workflow does not supply brokerage services.
  • Kentucky applicable property-specific notices. Investigate radon, flood and mine-subsidence risks, private water and sewage, permits, access and title during the negotiated inspection period. Seller must not conceal known material defects. No universal radon test or generic statutory packet is imposed on this ordinary private-owner resale.
  • Kentucky association resale records / supported exception. For a condominium subject to KRS 381.9203, seller must provide the declaration, bylaws/rules and current association-signed resale certificate with assessments, fees, finances, reserves, insurance, litigation and other required particulars. The association has ten days after written request. The purchaser may void the contract until certificate delivery and for five days thereafter or conveyance, whichever first occurs. Applicability and KRS 381.9201 exceptions must be established from the actual regime/transfer; upload supported exception evidence in place of an inapplicable certificate. NavStreet collects the applicable packet or evidence before offers without changing the statutory rights. An ordinary noncondominium HOA is not automatically governed by this condominium statute.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
