Selling a home in Maine: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Maine seller condition disclosure. For nonexempt residential transfers, 33 M.R.S. 173-174 requires the seller condition statement no later than the buyer makes an offer. Include water supply and known tests/PFAS problems, heating and service history, waste disposal/shoreland septic information, known hazards and defects, access and road maintenance, flood-zone information and the relevant FEMA map panel, flood/insurance/aid history, and shoreland enforcement matters. A true section 172 exception removes this statutory statement duty; it does not excuse misrepresentation. Late delivery preserves the statutory 72-hour withdrawal/termination remedy before settlement or occupancy as applicable, with prompt deposit return.
  • Maine property-specific supporting records. Seller shall provide available supporting records and correct known inaccuracies. No new universal water, radon or septic test is imposed merely by this agreement. Investigate title, access, systems and insurance during the negotiated inspection period. Property-specific shoreland septic inspection/transfer duties under 30-A M.R.S. 4216 remain applicable and are not replaced by a checkbox.
  • Maine association resale records. For an ordinary condominium resale subject to 33 M.R.S. 1604-108, seller shall furnish the declaration (excluding plats/plans), bylaws, rules and reasonably current resale certificate before contract execution, or otherwise before conveyance. The certificate addresses transfer restraints, assessments/fees, anticipated capital expenses, reserves, financials/budget, litigation, insurance and known violations. The purchase contract is voidable until certificate delivery and for five days thereafter or until conveyance, whichever occurs first. This right is not waived by a pending receipt answer or signature. Section 1601-102 extends the resale provision to older condominiums; section 1604-101(b) exceptions and developer public-offering rules remain distinct. No universal initial-offer packet gate is imposed.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
