Selling a home in Maryland: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Maryland seller condition disclosure or supported exception. For covered resales, upload the current seller-signed Maryland disclosure OR disclaimer before online offers open. A disclaimer still discloses actually known latent health or safety defects. For an actual Real Property 10-702(b)(2) exemption, upload signed evidence identifying it. The legal delivery deadline is on or before contract formation; NavStreet collects it earlier to avoid interrupting acceptance. Buyers must acknowledge the actual uploaded version.
  • Maryland applicable property-specific records. Any applicable completed and separately executed deferred water/sewer notice, NPL Superfund addendum, rental lead risk-reduction notice, local enforcement/impact-fee notice or agricultural-transfer-tax notice selected as Received in the statutory packet is expressly attached to and incorporated in this agreement. Seller must identify property-specific applicability and provide the complete facts and statutory text before contract formation. A generic receipt answer does not complete or sign a separate addendum. For recorded deferred charges, include the annual amount, payment month, ending date and collector name/address, prepayment information, and the statutory explanation that these are contractual private charges rather than county charges. Preserve the specific 14-117(b)(3) rescission, deposit-return and undisclosed-charge remedies. For property within one mile of an NPL site, separately identify the site and EPA search/dashboard URLs, obtain both dated signatures, and preserve the five-day cancellation and full-refund right under 10-714. The seller condition statement does not replace these contract addenda.
  • Condominium resale packet / HOA records. For condominium ownership, required under Real Property 11-135 no later than 15 days before closing, not universally before the initial offer. Upload declaration (excluding plats), bylaws and rules. For fewer than seven units, include the seller prior-12-month common-element expenses and deductible responsibility/amount notice. For seven or more units, include the complete council certificate, current budget and reserve study or summary/reserve status, financials, assessments/fees, planned capital expenses, judgments/litigation, insurance, applicable warranty-claim settlements, owner statements about alterations/code/extended leases/asbestos, and deductible notice. Buyer retains seven days to cancel after ALL required information arrives, until closing; no waiver. Ordinary HOA lots use 11B-106 documents and its distinct timing/cancellation rights. Optional at initial offer entry; upload does not acknowledge buyer receipt.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
