Selling a home in Minnesota: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Minnesota seller disclosure or lawful exception evidence. Seller-signed known material facts statement under Minn. Stat. 513.55, or signed evidence of a specific 513.54 exception or lawful written mutual 513.60 waiver. Independent radon, well, sewage and other disclosure duties remain.
  • Minnesota property-specific statutory and local records. Provide the applicable radon disclosure, current known reports and mitigation records, exact warning and MDH Radon in Real Estate Transactions publication; wells location/status/map or no-known-well statement; permitted-sewer or onsite-sewage statement/map and available reports. Include Washington County special-well-construction-area information when applicable, known meth production and CWD premises notices, and local records such as Minneapolis Truth in Sale of Housing. Identify any independent statutory exception in signed evidence. New uninhabited construction is not a blanket radon exception.
  • Minnesota association resale packet. For a covered Chapter 515B resale provide governing documents, required financial/association information and a resale certificate not more than 90 days old, including the current preventative maintenance plan, schedule and budget or their electronic availability as specified by the certificate. Effective January 1, 2027 include required fine/remedy and collection policies, any reserve study obtained within the preceding three years and updated certificate information. This upload does not waive the buyer’s cancellation rights.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
