Selling a home in Montana: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Montana seller condition disclosure or supported exception. For covered residential transfers under MCA 70-20-502, seller shall disclose actual knowledge of adverse material facts before or contemporaneously with contract execution, including title, water source/service, wastewater, utilities, structure/water intrusion, systems and known physical problems. No duty to inspect is imposed solely by this statement. Identify any actual 70-20-503 exception in signed evidence. NavStreet requires the statement or exception evidence before buyer offer creation as an earlier platform safeguard. Under 70-20-504, unless otherwise agreed in writing, late delivery gives buyer three days from delivery to deliver a separately signed written rescission statement. This agreement does not waive that right. The separate statement is not a warranty under 70-20-505; a receipt selection does not sign a separate statement.
  • Montana applicable property-specific records. MCA 75-3-606 requires the radon warning with or before the offer and buyer signature acknowledging a copy. Buyer’s signature on this agreement acknowledges receipt of the radon statement printed below, after reviewing it in the offer questions. Known prior tests and subsequent mitigation/treatment evidence shall be provided before or upon contract entry. That statute does not independently require a new test or create a cancellation contingency; the negotiated inspection contingency remains. Under current MCA 75-10-1305, known methamphetamine or fentanyl lab use/contamination requires written notice before agreement to sale when not remediated to certified standards; provide certified compliance/remediation evidence and appropriate notice when applicable. A seller-statement exception does not waive these separate requirements.
  • Montana condominium packet. Required before online offers for condominium ownership. NavStreet requires this earlier upload to prevent missing-document interruptions for buyers. For a Montana condominium resale, upload a complete packet containing the Unit Ownership Act, association bylaws and administrative regulations. Include the seller or other person’s majority-control notice under MCA 70-23-613(1) whenever any person or entity constitutes a majority of the unit owners. Deliver requested documents before any buy-sell signing. The agreement preserves the 72-hour review and penalty-free withdrawal period. These condominium documents are not a universal upload requirement for non-condominium properties. Dues, assessments and other helpful records may accompany the packet; unknown information is not assigned to the buyer.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
