Selling a home in Nebraska: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Nebraska seller disclosure or supported exemption evidence. For a covered residential transaction under Neb. Rev. Stat. 76-2,120, seller shall complete and execute the current State Real Estate Commission Seller Property Condition Disclosure Statement, identify the address and legal description, disclose the required condition/title/hazard/utility/private-transfer-fee and carbon-monoxide-alarm information, and update inaccurate information known to seller on or before the effective date binding buyer. Deliver the statement and updates by that effective date, with buyer written receipt acknowledgment. Unknown answers are permitted when information is unknown. The statement is not a warranty or inspection substitute and is legally separate from the purchase contract. Document a specific subsection (6) exemption; an as-is clause is not an exemption. Receipt selection in NavStreet does not execute the separate statutory acknowledgment.
  • Nebraska applicable statutory records. Failure to comply with 76-2,120 does not alone invalidate a transfer. Preserve applicable actual-damage, court-cost and attorney-fee rights and the statutory one-year limitation measured from possession or conveyance, whichever is first; this agreement does not create a generic rescission period. Under 40-104, title shall confirm necessary spouse signatures for homestead property. A purchase agreement signed by both spouses does not require acknowledgment merely to be enforceable, while the homestead conveyance has separate execution/acknowledgment requirements. Buyer shall investigate the property, water rights and quality, wells/septic systems, access, zoning, hazards and insurance within the negotiated inspection period. Verify applicable carbon-monoxide requirements and local occupancy, sewer/septic and transfer obligations. Title shall verify legal description, owners, marital interests, liens, easements and deed/recording. Association records and leases must be obtained when applicable but this agreement does not invent a universal pre-offer HOA packet. Seller tax bills do not guarantee buyer taxes. This original agreement covers ordinary existing fee-simple single-family, townhome and PUD resales with cash or conventional financing. Although 76-2,120 covers additional transaction categories, ground leases, leases with purchase options, condominiums, manufactured homes, vacant land, new construction/developer sales, installment seller financing and wholesale assignments are outside this initial product. Those categories need separately reviewed contracts; the narrower product scope is not a statement that the statute excludes them.
  • Nebraska association records. Provide applicable recorded restrictions, assessments, fees, contact information and resale records. Not a universal pre-offer upload requirement.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
