Selling a home in New Hampshire: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • New Hampshire seller disclosure or supported exemption evidence. Under RSA 477:4-d, seller shall provide the required written information before or during offer preparation: private water supply type/location/malfunctions/install date/latest test and known test problems; private sewage location/malfunctions/latest service and contractor; insulation type/location; federally designated flood-zone status; and presence of a residential heating-oil underground storage tank. The tank requirement effective August 4, 2026 is included. State in writing when required water, sewage or insulation information is unavailable. Buyer shall acknowledge receipt by signing a copy of the disclosure; a NavStreet received selection alone does not sign that copy.
  • New Hampshire applicable statutory records. Before execution, RSA 477:4-a requires the exact current notification concerning radon, arsenic, lead, PFAS and flood, and buyer acknowledgment by signing a copy. Provide the complete prescribed notice as a separate signed attachment. General discussion in this contract, a federal lead attachment, a checkbox or a hazard report does not replace that notification. The statute does not itself mandate a universal new radon/arsenic/PFAS test; buyer may negotiate investigations. All statutory rights and limitations remain. RSA 477:4-g requires applicable known production disclosure before signing during the statutory period preceding an authoritative remediation determination; verify records with DES or the authorized specialist. RSA 477:4-h requires applicable metered utility tariff financing disclosures before or during offer preparation and before signing, including known remaining term/charges and available savings records, or written unavailable information, with buyer signed acknowledgment. Include both applicability statements and applicable records in the required packet. No automatic cleanup or tariff exemption is created by this agreement. RSA 506:1 requires the applicable signed writing and written agent authority. Title shall confirm necessary owners/spouses, legal description, liens, deed execution and registry recording. Current RSA 477:22-b through 22-f restrict covered foreign principals; closing professionals must evaluate actual statutory definitions and current legal status. This package does not impose a proposed ten-mile purchaser-affidavit rule as if enacted. This original agreement supports existing fee-simple single-family, townhome and PUD resales with cash or conventional funding; condominiums, manufactured homes, land, new construction/developer, leasehold, seller installment financing and wholesale assignments require separate reviewed agreements.
  • New Hampshire association records. Provide applicable recorded restrictions, assessments, fees, contact information and resale records. Not a universal pre-offer upload requirement.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
