Selling a home in New Mexico: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • New Mexico optional seller condition information. This ordinary resale package does not impose a universal state-prescribed seller condition form as a prerequisite to an offer. Seller shall disclose known adverse material facts and shall not misrepresent or actively conceal conditions. A voluntarily supplied condition statement is not a warranty or substitute for inspection. Professional broker duties under 16.61.19 NMAC apply to licensed brokers; they do not make NavStreet a broker or create a statewide FSBO form requirement. A receipt answer records actual delivery, not a completed or signed separate statement.
  • New Mexico assessor tax estimate and applicable notices. Before online offers open, upload the county assessor written tax-levy estimate at the listed price under NMSA 47-13-4. A current seller tax bill is insufficient. If the estimate is not readily available, answer Yes on the listing and upload written supporting evidence; each buyer must expressly sign the statutory waiver before making an offer. Also include any applicable known drug-contamination notices; the tax waiver does not waive hazard disclosures. The legal estimate delivery deadline is before seller acceptance; NavStreet collects the evidence earlier to avoid replacement offers.
  • Condominium resale packet / HOA records. For condominiums subject to NMSA 47-7D-9, furnish declaration (other than plats/plans), bylaws, rules and association resale certificate before conveyance. Certificate includes transfer restraints, assessments/unpaid amounts, other fees, capital expenditures for current and next two fiscal years, reserves, recent financials, current budget, judgments, insurance and any leasehold term. Buyer may void until the certificate is supplied and for seven days after receipt or conveyance, whichever first. Verify 47-7A-2 applicability to older condominiums and 47-7D-1(B) exceptions. This agreement also gives equivalent contractual document-review protection without inventing a universal pre-offer upload deadline. Non-condominium HOA records use 47-16-11 through -13. Do not substitute HOA fees for condominium ownership.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
