Selling a home in Ohio: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Ohio seller condition disclosure or supported exception. For a covered R.C. 5302.30 transfer, seller shall complete applicable items in the current prescribed Residential Property Disclosure Form and deliver a signed, dated copy as soon as practicable. State actual knowledge in good faith; the form is not a warranty or substitute for inspection. Buyer shall sign/date a copy acknowledging receipt and return it to seller or seller’s agent by a legally permitted method. A NavStreet received dropdown does not sign or return that separate form. Document the specific subsection (B)(2) exception when claimed. Amendments and independent fraud/common-law disclosure duties remain. Optional association records do not universally block an offer.
  • Ohio applicable property-specific records. Under R.C. 5302.30(K), when the form or amendment is received after entering the transfer agreement, buyer may rescind in a written, signed, dated notice delivered to seller or seller’s agent within three business days after receipt, and no later than the earlier of thirty days after seller acceptance or closing, subject to statutory conditions. If no form is received, the missing-form rescission deadline is the earlier of thirty days after acceptance or closing. Applicable deposits must be returned. Receipt before submission of the offer and entry into the agreement affects the statutory rescission entitlement. No automatic waiver is created by selecting received, signing this agreement or entering an inspection period. Other remedies remain. Statutory delivery methods and legally valid electronic-consent requirements must be observed.
  • Ohio association records. For a Montana condominium resale, upload a complete packet containing the Unit Ownership Act, association bylaws and administrative regulations. Include the seller or other person’s majority-control notice under MCA 70-23-613(1) whenever any person or entity constitutes a majority of the unit owners. Deliver requested documents before any buy-sell signing. The agreement preserves the 72-hour review and penalty-free withdrawal period. These condominium documents are not a universal upload requirement for non-condominium properties. Dues, assessments and other helpful records may accompany the packet; unknown information is not assigned to the buyer.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
