Selling a home in Pennsylvania: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Pennsylvania seller condition disclosure. For a covered residential transfer, 68 Pa.C.S. 7303 requires a signed and dated disclosure of known material defects before seller and buyer sign an agreement of transfer. Use the statutory statement or a compliant form covering the required subjects; assess chapter 71 scope and 7302 exceptions accurately. Condominium sellers disclose their own unit under this chapter, not common elements; association resale duties apply separately. No new independent investigation is universally required to complete the condition statement. Upload the applicable signed statement before offers.
  • Pennsylvania property-specific statutory notices. Known radon, water intrusion, environmental, structural, utility and other material defects belong in the condition disclosure and available records; no universal independent radon, termite, septic or inspection certificate upload is imposed merely to make an offer. Qualified inspections and local point-of-sale requirements remain property-specific. Seller shall provide applicable updates; a receipt does not warrant condition or waive fraud, disclosure remedies or protected cancellation rights.
  • Pennsylvania association resale documents. For an applicable nondeclarant condominium resale under 68 Pa.C.S. 3407 or planned-community resale under 5407, seller shall furnish the governing declaration, bylaws/rules and the association resale certificate before conveyance, subject to statutory scope and exceptions. The certificate addresses assessments/fees, capital expenses, reserves/budgets, litigation, insurance and other required matters. Buyer is not liable for undisclosed assessments/fees beyond statutory limits. The purchase contract is voidable until the certificate is provided and for five days thereafter or until conveyance, whichever occurs first. A negotiated inspection deadline or signature does not shorten the statutory right. Pending association records do not universally block making or accepting an offer. Public-offering/declarant, cooperative, new-construction and leasehold transactions require separate agreements.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
