Selling a home in Rhode Island: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Rhode Island seller condition disclosure / supported exception. R.I. Gen. Laws 5-20.8-2 requires the seller disclosure before the buyer signs an agreement, unless a specific 5-20.8-3 transfer exception applies. Upload the completed current disclosure and available required supporting records, or a written statement identifying the actual statutory exception. The form addresses systems, radon, lead records, water/sewage, surveys, easements, wetlands and shoreline/public-access records; do not substitute a generic placeholder. Exception evidence does not itself waive independent federal lead duties.
  • Rhode Island applicable property-specific notices. If the property is or may be served by a private cesspool, 5-20.8-13 provides a ten-day sewage-system inspection opportunity before the purchaser becomes obligated, unless the parties mutually agree on a different period. This agreement preserves ten days independently of the negotiated general inspection period. Seller must provide available required prior results and private-well, survey, restriction and coastal permit/access records with the disclosure. No acknowledgement certifies that an unknown condition is absent.
  • Rhode Island association resale records / supported exception. For covered condominium resales, 34-36.1-4.09 requires the declaration, bylaws/rules and association certificate with the prescribed assessment, financial, insurance, litigation, code-violation and leasehold information. The association must furnish it within ten days of request. The purchase contract remains voidable until delivery and for five days thereafter or conveyance, whichever occurs first; the purchaser is protected against undisclosed excess assessments/fees. Scope and 4.01 transfer exceptions require actual support. Upload the complete applicable packet or documented exception before offers under NavStreet's collection policy; no automatic waiver or statutory waiting-period replacement results.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
