Selling a home in South Dakota: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • South Dakota seller condition disclosure or supported exception. For covered residential transfers, SDCL 43-4-38 requires the current 43-4-44 condition statement before buyer makes a written offer. The statement covers the property and known conditions, including applicable water, radon, hazardous materials and private transfer fees; it is not a warranty or substitute for independent inspection. Identify an actual 43-4-43 exception in signed evidence. Each buyer and seller must complete the separate required signature/initial spaces; an agreement signature does not fill or initial the seven-page statement. Seller must deliver written material amendments before closing or possession, whichever comes first. If a statement or material amendment arrives after the written offer, 43-4-39 permits written termination within three days after in-person delivery or six days after deposit in mail. Do not silently substitute business days or assume electronic delivery changes these statutory periods.
  • South Dakota applicable property-specific records. SDCL 43-4-44.1 independently requires, before buyer makes a written offer, notice that the property is governed by an HOA, its governing documents, assessment amount/frequency/purpose and special one-time assessments from the most recent three years. This applies to all residential transfers after July 1, 2024. A condition-statement exception does not remove this separate HOA duty. Supply written amendments for material changes before closing or possession, whichever comes first. The ordinary condition statement alone is not the complete HOA packet.
  • Condominium / association packet. Required for condominium or other property governed by an association meeting SDCL 43-4-44.1: before buyer makes a written offer, provide association notice, governing documents, assessment amount/frequency/purpose and special one-time assessments for the most recent three years. For a condominium include its master deed/declaration, bylaws/rules and available final/substitute Commission report and supplements. A condition-statement exception does not remove the independent association duty. Developer offerings and their 43-15A-19 ten-day report-review process are outside this ordinary resale package. No HOA or zero dues cannot exclude condominium ownership.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
