Selling a home in Tennessee: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Tennessee seller condition disclosure / supported exception. For a covered residential transfer, Tenn. Code Ann. 66-5-202 and 66-5-203 require the condition disclosure before contract acceptance. Upload that disclosure, or evidence of a specific 66-5-209 exception. A disclaimer is allowed only with the purchaser's genuine waiver; the seller cannot choose that waiver for a buyer. This workflow uses the disclosure route unless an independent buyer waiver has already been executed and included in the uploaded packet. NavStreet gathers the applicable document before offers. Material changes must be disclosed or condition recertified at closing.
  • Tennessee applicable property-specific notices. Separately disclose applicable known exterior injection wells and percolation/soil-absorption tests, a moved foundation and known sinkholes under 66-5-212; a sinkhole requires written disclosure and acknowledgement before contract. Other applicable written notices include 66-5-211 impact fees/adequate-facilities taxes 66-5-213 planned-unit-development obligations, and applicable 68-221-409 future public-sewer connection obligations. A condition-form exception does not erase an independent notice duty. Upload one complete property-notice packet when these facts apply, without duplicating records already in the condition packet. Statutory condominium association information is available on request under 66-27-502 and 503; it is not a universal initial-offer upload requirement.
  • Tennessee association resale records / supported exception. For residential condominium ownership, buyer is entitled on request to association information under 66-27-502 and 503, including administration, governing documents, assessments, budget, insurance, litigation and other prescribed records. The association generally responds within ten business days. Seller must explain how to contact it when requested. This ordinary resale agreement does not invent a universal five-day condominium cancellation rule or make request-based records an unconditional offer gate. Review records under the negotiated inspection period; statutory duties and remedies remain. PUD disclosures under 66-5-213 are separate from condominium classification.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
