Selling a home in Virginia: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Virginia seller disclosure / supported exception. For a covered Virginia transfer, furnish the current Real Estate Board residential property disclosure statement before ratification under sections 55.1-703 and 55.1-709, or identify and document an actual section 55.1-702 exception. This is a buyer-beware notice, not a seller condition warranty. Required affirmative notices remain independent. Delayed delivery can carry statutory termination rights; no waiver is created here. Use the official version effective on delivery, including the January 1, 2027 revision when applicable; section 55.1-709 preserves correctly delivered earlier notices for an existing ratified transaction.
  • Virginia applicable property-specific notices. Provide applicable affirmative notices for military-air-installation zones, pending building/zoning violations, lis pendens, unremediated methamphetamine manufacture, stormwater-management facilities and repetitive flood loss, including any duties surviving a general transfer exception. Select the seller applicability question accurately and upload the complete notice packet when applicable. Buyer should investigate flood, drainage, water/sewage, zoning, access and other buyer-beware matters; this does not waive nonwaivable remedies.
  • Virginia association resale records / supported exception. Virginia Resale Disclosure Act sections 55.1-2309 through 55.1-2312 require covered association resale certificates, subject to section 55.1-2317. Obtain all applicable association records. This agreement uses the statutory default three-day cancellation period: from ratification when delivered earlier, or from receipt when delivered later; if no certificate or unavailability notice is delivered, cancellation remains available before settlement. Multiple associations run from the last delivery. Preserve written notice, deposit-return and other statutory rights. NavStreet collects the certificate, lawful unavailability notice or supported exception evidence before offers without changing the legal delivery/cancellation rules.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
