Selling a home in West Virginia: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • West Virginia seller condition disclosure / supported exception. No universal West Virginia private-owner residential condition form is imposed by this package. Seller must truthfully disclose known latent material defects and avoid concealment or misrepresentation. Buyer should investigate structural, flood, environmental, radon, mining/subsidence, mineral/title, water and sewage risks; inspection rights do not excuse fraud.
  • West Virginia applicable property-specific notices. Review severed mineral interests, support rights, access, private water/sewage, flood and title records as applicable. Known material defects must not be concealed. This ordinary existing-resale agreement does not cover developer offerings, cooperatives, leasehold or installment land contracts. No universal radon testing packet is imposed.
  • West Virginia association resale records / supported exception. For a common-interest community within chapter 36B's applicable scope, 36B-4-109 requires governing documents and a resale certificate with assessments, fees, finances, reserves, insurance, litigation, violations and other prescribed information. The association generally has ten days after request. The contract is voidable until certificate delivery and for five days thereafter or conveyance, whichever first occurs; undisclosed excess fees/assessments are protected. Apply 36B-1-203 through 205 and 4-101 scope/transfer exceptions to the actual community. NavStreet collects the applicable packet or specific supported scope/exception evidence before offers. A PUD or single-family lot may be in a covered community; a physical condo label is not the only trigger. This does not remove cancellation rights.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
