Selling a home in Wyoming: disclosures and documents

These are topics addressed in NavStreet's state disclosure reference. Whether a document is required depends on the property, transaction, and applicable exemptions.

  • Wyoming seller condition disclosure or supported exception. This ordinary resale package does not require a universal Wyoming statutory seller condition form before an offer. Seller shall truthfully disclose known material conditions, answer specific inquiries and avoid misrepresentation or active concealment. Any voluntarily supplied condition statement remains separate from this agreement and is not a warranty or independent inspection. Licensed agent adverse-material-fact and relationship duties under W.S. 33-28-303 and 33-28-306 apply when such professionals participate; they do not make this FSBO platform a broker. This agreement does not add a broad as-is waiver of fraud or other available remedies.
  • Wyoming applicable property-specific records. Verify water and irrigation rights with the State Engineer, including permits, adjudication, well access and any deed reservations or severance. Under applicable Wyoming water law, identify seller-owned appurtenant rights intended to convey rather than infer ownership from a visible well or ditch. Seller shall provide existing records; title and closing professionals shall complete required transfers and ownership updates. Review mineral/surface estates, easements, physical/legal access, shared wells and development restrictions during inspection. No new water test or radon test is universally required solely by this agreement.
  • Condominium / association records. For condominium ownership, obtain the recorded declaration, bylaws/rules and common-element interests, assessments and unpaid balances, insurance and deductible information, reserves and any parking/storage restrictions. Wyoming does not impose a universal ordinary-condominium-resale packet or review-period prerequisite to the initial offer. These recommended records remain optional for offer entry; negotiated inspection and contract rights apply. Developer, new-construction and leasehold sales require a separate agreement.

Federal lead-based paint disclosure rules may apply to housing built before 1978. This information is educational, not legal advice; requirements vary by property and transaction.
